How many times have you been walking down the road and noticed that there has been a missing paving slab or a dip in the pavement and you have thought to yourself - glad I noticed that or I could have had an accident?
If you did have an accident which was caused by tripping over a missing or uneven paving stone, a hole in the pavement or some other defect you could be entitled to compensation.
In order to prove a claim of this type it is necessary for you to obtain a number of good quality photographs showing the extent of the defect. Ideally, you will need to make sure that any photographs show the depth and size of the defect. You will need to ensure that a ruler is used to measure the same. It is possible on a tripping hazard to place a 50 pence piece next to the defect to show the extent of it.
In addition to the photographs, you will need some good witnesses as to the length of time that the defect has been present. The witnesses would need to be independent and would need to show that the defect has been there for at least 6 months.
